It blows my mind how little americans read or understand the LAW. Even those who claim to be involved in the law as a profession fail to understand what the supreme court’s opinion of the tax issue claims. Question: If Mr. Snipes violated IRC section 7203, what is the enforcement regulation [sometimes referred to as the implementing regulation] which enforces the statute referred to as 7203? OK knowledgeable and opinionated ones do your homework. Additionally, most brilliant ones it is quite elementary that one must first *identify a taxing statute, 2. prove application of a liability statute before a penalty statute is applicable without the first two elements, a federal court lacks subject matter jurisdiction to impose a penalty, whether civil or criminal. None of these elements were present in Mr. Snipes case. Let’s start having real knowledgeable conversations and keep the opinions in the pool halls and golf courses.
