But those are the cases you have to decline.  

I would think, based on Judge Thornton&#039;s opinion, that Arnold might have a malpractice claim against his attorney.  

But in order to recover anything, he&#039;d have to be able to prove that he would have won had it not been for his lawyer&#039;s unpreparedness.</description>
